Article 764-11 of the French Code of Criminal Procedure

The public prosecutor shall forward to the competent authority of the executing State a certified copy of the sentencing decision or probation decision and the original or a copy of the certificate referred to in Article 764-6.

He shall also send that authority a translation of the certificate either into the official language or one of the official languages of the executing State, or into one of the official languages of the institutions of the European Union accepted by that State.

On the occasion of this transmission, it may ask the competent authority of the executing State for the maximum period of deprivation of liberty provided for by the national law of the executing State for the offence which gave rise to the conviction, and which could be imposed on the sentenced person in the event of non-compliance with alternative sanctions or probation measures.

Article 764-11

Le ministère public transmet à l’autorité compétente de l’Etat d’exécution une copie certifiée conforme de la décision de condamnation ou de la décision de probation ainsi que l’original ou une copie du certificat mentionné à l’article 764-6.

Il transmet, en outre, à cette autorité une traduction du certificat soit dans la langue officielle ou dans une des langues officielles de l’Etat d’exécution, soit dans l’une des langues officielles des institutions de l’Union européenne acceptées par cet Etat.

A l’occasion de cette transmission, il peut demander à l’autorité compétente de l’Etat d’exécution la durée maximale de la privation de liberté prévue par le droit interne de l’Etat d’exécution pour l’infraction qui a donné lieu à la condamnation, et qui pourrait être prononcée à l’encontre de la personne condamnée en cas de non-respect des peines de substitution ou des mesures de probation.
