Article 764-5 of the French Code of Criminal Procedure

A conviction or a probation decision may be transmitted to the competent authority of another Member State of the European Union where:

1° The person concerned is ordinarily resident, under lawful conditions, in the territory of that State and has returned to it or wishes to return to it;

2° The person concerned is not ordinarily resident, under lawful conditions, in the territory of that State, but requests to enforce his sentence or probation measure there, provided that the competent authority of that State consents to the transmission of the conviction or probation decision concerning him.

Une condamnation ou une décision de probation peut être transmise à l’autorité compétente d’un autre Etat membre de l’Union européenne lorsque :

1° La personne concernée réside de manière habituelle, dans des conditions régulières, sur le territoire de cet Etat et y est retournée ou souhaite y retourner ;

2° La personne concernée ne réside pas de manière habituelle, dans des conditions régulières, sur le territoire de cet Etat, mais demande à y exécuter sa peine ou mesure de probation, à condition que l’autorité compétente de celui-ci consente à la transmission de la décision de condamnation ou de probation la concernant.
