Article 776 of the French General Tax Code

I. – The provisions of I of article 764 are applicable to the assessment of transfer duties inter vivos, free of charge, whenever the furniture transferred is sold publicly within two years of the deed of gift.

II. – With regard to jewellery, gems, works of art or collectors’ items, the taxable value may not, subject to what is stated in I, be less than 60% of the valuation made in the theft or fire insurance contracts or agreements in force on the date of the gift and entered into by the donor, his spouse or his authors for less than ten years.

If there are several policies that may be used for the application of the lump sum, it is calculated on the average of the valuations appearing in these policies.

I. – Les dispositions du I de l’article 764 sont applicables à la liquidation des droits de mutation entre vifs, à titre gratuit, toutes les fois que les meubles transmis sont vendus publiquement dans les deux ans de l’acte de donation.

II. – En ce qui concerne les bijoux, pierreries, objets d’art ou de collection, la valeur imposable ne peut, sous réserve de ce qui est dit au I, être inférieure à 60 % de l’évaluation faite dans les contrats ou conventions d’assurances contre le vol ou contre l’incendie en cours à la date de la donation et conclus par le donateur, son conjoint ou ses auteurs depuis moins de dix ans.

S’il existe plusieurs polices susceptibles d’être retenues pour l’application du forfait, celui-ci est calculé sur la moyenne des évaluations figurant dans ces polices.
