Article 785 of the French Code of Criminal Procedure

A pardon may only be applied for in court, during the convicted person’s lifetime, by the latter or, if he or she is banned, by his or her legal representative; in the event of death and if the legal conditions are met, the application may be followed by his or her spouse or by his or her ascendants or descendants and even made by them, but only within a period of one year from the date of death.

The application must relate to all convictions handed down that have not been erased by a previous pardon.

La réhabilitation ne peut être demandée en justice, du vivant du condamné, que par celui-ci, ou, s’il est interdit, par son représentant légal ; en cas de décès et si les conditions légales sont remplies, la demande peut être suivie par son conjoint ou par ses ascendants ou descendants et même formée par eux, mais dans le délai d’une année seulement à dater du décès.

La demande doit porter sur l’ensemble des condamnations prononcées qui n’ont pas été effacées par une réhabilitation antérieure.
