Article 807-1 of the French Code of civil procedure

At any time, all of the constituted parties may apply to the Pre-Trial Judge for the partial closure of the investigation.

In support of their request, they shall produce a deed countersigned by lawyers that sets out the claims in respect of which they are seeking a partial judgment.

If the application is granted, the judge shall order the partial closure of the investigation and refer the case back to the court for a decision on the merits of the claim or claims determined by the parties. The document countersigned by lawyers is attached to the order.

The date of partial closure must be as close as possible to the date set for oral argument.

The article 798, paragraphs 2 to 4 of the article 799 as well as the articles 802 to 807 are applicable to the this subsection.

Article 807-1

A tout moment, l’ensemble des parties constituées peut demander au juge de la mise en état la clôture partielle de l’instruction.

Elles produisent à l’appui de leur demande un acte contresigné par avocats qui mentionne les prétentions à l’égard desquelles elles sollicitent un jugement partiel.

S’il fait droit à la demande, le juge ordonne la clôture partielle de l’instruction et renvoie l’affaire devant le tribunal pour qu’il statue au fond sur la ou les prétentions déterminées par les parties. L’acte contresigné par avocats est annexé à l’ordonnance.

La date de la clôture partielle doit être aussi proche que possible de celle fixée pour les plaidoiries.

L’article 798, les alinéas 2 à 4 de l’article 799 ainsi que les articles 802 à 807 sont applicables à la présente sous-section.
