Article 82 bis of the French Customs Code

1. Unless there are special provisions to the contrary, goods brought before customs under the conditions laid down in Articles 68 to 82 above may be constituted into warehouses or customs clearance areas in accordance with the procedures laid down in this chapter.

2. The creation of warehouses and customs clearance areas is subject to authorisation from the Director General of Customs and Excise, who shall approve their location, construction and layout.

3. The authorisation referred to in paragraph 2 of this Article sets out the conditions to which the operation of the warehouses and customs clearance areas is subject and, where applicable, lays down the operator’s obligations with regard to the supply, maintenance and repair of the facilities required for the performance of the service.

Article 82 bis

1. Sauf dispositions spéciales contraires, les marchandises conduites en douane dans les conditions prévues aux articles 68 à 82 ci-dessus peuvent être constituées en magasins ou en aires de dédouanement suivant les modalités fixées au présent chapitre.

2. La création de magasins et aires de dédouanement est subordonnée à l’autorisation du directeur général des douanes et droits indirects qui en agrée l’emplacement, la construction et l’aménagement.

3. L’autorisation visée au 2 du présent article détermine les conditions auxquelles le fonctionnement des magasins et aires de dédouanement est subordonné et fixe éventuellement les charges de l’exploitant en matière de fourniture, d’entretien et de réparation des installations nécessaires à l’exécution du service.
