Article 849-13 of the French Code of civil procedure

The information measures ordered by the judge shall include, in addition to any particulars prescribed by the judgment:

1° A reproduction of the operative part of the decision;

2° Depending on whether the collective winding-up procedure or the individual compensation procedure is applied, the contact details of the party or parties to whom each interested party may address their claim for compensation;

> The form and content of the claim and the procedure to be followed
3° The form and content of the claim for compensation and the time limit within which it must be sent, in the context of an individual procedure for compensation for loss or damage, at the option of the person concerned, either to the person declared liable or to the claimant in the action, and in the context of a collective procedure for the liquidation of loss or damage, to the claimant in the action;

4° An indication that the claim for compensation sent to the plaintiff in the action confers on him a mandate for the purposes of compensation and, where applicable, in the event of a refusal of compensation by the person declared liable, for the purposes of representation in order to bring an action for compensation or for the compulsory enforcement of the judgment handed down at the end of this action, as well as an indication that he may terminate it at any time and that this mandate is not equivalent to or implies membership of the association bringing the action;

5° An indication that, in the absence of a claim for compensation received in accordance with the procedures and within the time limit laid down in the judgment, the person concerned will no longer be entitled to obtain compensation under the group action but will still be able to seek compensation for his or her losses on an individual basis;

6° An indication that, in the absence of a claim for compensation received in accordance with the procedures and
6° An indication that, in the event of membership, the person concerned will no longer be able to take individual action against the person declared liable for compensation for the damage already compensated under the group action but that he or she will still be able to take action for compensation for his or her other damage;

7° An indication that the interested party must produce any useful document in support of his claim.

Article 849-13

Les mesures d’information ordonnées par le juge comportent, outre les mentions éventuellement prescrites par le jugement :

1° La reproduction du dispositif de la décision ;

2° Selon qu’il est fait application de la procédure collective de liquidation ou de la procédure individuelle de réparation, les coordonnées de la ou des parties auprès desquelles chaque personne intéressée peut adresser sa demande de réparation ;

3° La forme, le contenu de cette demande de réparation ainsi que le délai dans lequel elle doit être adressée, dans le cadre d’une procédure individuelle de réparation des préjudices, au choix de la personne intéressée, soit à la personne déclarée responsable, soit au demandeur à l’action, et dans le cadre d’une procédure collective de liquidation des préjudices, au demandeur à l’action ;

4° L’indication que la demande de réparation adressée au demandeur à l’action lui confère un mandat aux fins d’indemnisation et, le cas échéant, en cas de refus d’indemnisation opposé par la personne déclarée responsable, aux fins de représentation pour engager une action en réparation ou pour l’exécution forcée du jugement prononcé à l’issue de cette action, ainsi que l’indication qu’elle peut y mettre fin à tout moment et que ce mandat ne vaut ni n’implique adhésion à l’association qui engage l’action ;

5° L’indication que, à défaut de demande de réparation reçue selon les modalités et dans le délai prévu par le jugement, la personne intéressée ne sera plus recevable à obtenir une indemnisation dans le cadre de l’action de groupe mais qu’elle pourra toujours agir en indemnisation de ses préjudices à titre individuel ;

6° L’indication qu’en cas d’adhésion, la personne intéressée ne pourra plus agir individuellement à l’encontre de la personne déclarée responsable en réparation du préjudice déjà indemnisé dans le cadre de l’action de groupe mais qu’elle pourra toujours agir en indemnisation de ses autres préjudices ;

7° L’indication que la personne intéressée doit produire tout document utile au soutien de sa demande.
