Article 851 of the French Code of civil procedure

The judge responsible for supervising the execution of measures of inquiry, appointed under the conditions of Article 155-1, is competent to supervise the investigative measures ordered in summary proceedings, unless otherwise decided when the judges are allocated to the different chambers and departments of the court.

He also has jurisdiction over measures ordered by the pre-trial judge pursuant to Article 789, unless the latter reserves control of them.

Article 851

Le juge chargé de contrôler l’exécution des mesures d’instruction, désigné dans les conditions de l’article 155-1, est compétent pour assurer le contrôle des mesures d’instruction ordonnées en référé, sauf s’il en est décidé autrement lors de la répartition des juges entre les différentes chambres et services du tribunal.


Il est également compétent pour les mesures ordonnées par le juge de la mise en état en application de l’article 789, sauf si ce dernier s’en réserve le contrôle.
