Article 88-1 of the French Code of Criminal Procedure

The deposit set pursuant to Article 88 guarantees payment of the civil fine that may be imposed pursuant to Article 177-2.

The sum deposited is returned when this fine has not been imposed by the investigating judge or, in the event of an appeal by the public prosecutor or the civil party, by the investigating chamber.

Article 88-1

La consignation fixée en application de l’article 88 garantit le paiement de l’amende civile susceptible d’être prononcée en application de l’article 177-2.

La somme consignée est restituée lorsque cette amende n’a pas été prononcée par le juge d’instruction ou, en cas d’appel du parquet ou de la partie civile, par la chambre de l’instruction.
