Article A134-3 of the French Insurance Code

The revaluation of guarantees referred to in the 2nd paragraph of article R. 134-4 may only take place if it enables the following two conditions to be met:

1° The amount of the diversification provision corresponding to the guarantees covered by 1° of article L. 134-1 is greater than one and a half times the difference between the amount of the mathematical provisions which would have to be entered if the discount rate used to calculate them were zero and the amount of the mathematical provisions;

2° The difference between the amount of the diversification provision corresponding to the guarantees covered by 1° of Article L. 134-1 and the minimum amount of this provision calculated on the basis of the minimum value of the units referred to in Article R. 134-1 is greater than 10% of the amount of the mathematical provisions.

La revalorisation des garanties mentionnée au 2e alinéa de l’article R. 134-4 ne peut intervenir que si elle permet de respecter les deux conditions suivantes :

1° Le montant de la provision de diversification correspondant aux garanties relevant du 1° de l’article L. 134-1 est supérieur à une fois et demie la différence entre le montant des provisions mathématiques qui seraient à inscrire si le taux d’actualisation retenu pour leur calcul était nul et le montant des provisions mathématiques ;

2° La différence entre le montant de la provision de diversification correspondant aux garanties relevant du 1° de l’article L. 134-1 et le montant minimal de cette provision calculé à partir de la valeur minimale des parts mentionnée à l’article R. 134-1 est supérieure à 10 % du montant des provisions mathématiques.
