Article A134-5 of the French Insurance Code

An interim diversification provision is calculated at least each month in which the profit-sharing account is not closed. It is equal to the difference between the realisable value of the assets determined in accordance with the provisions of articles R. 343-11 and R. 343-12 and the sum of the provisions mentioned in 1°, 4°, 7°, 10° and 11° of article R. 343-3.

For the application of the second paragraph of article R. 134-2 and article R. 134-5, the value of the diversification provision share to be retained is equal to the value of the share determined at the next profit-sharing account statement date or, if an interim amount is calculated before this statement date, at the next interim amount divided by the number of diversification provision shares at the date of calculation of this interim amount.

Article A134-5

Un montant intermédiaire de provision de diversification est calculé au moins chaque mois où n’est pas effectué l’arrêté du compte de participation aux résultats. Il est égal à la différence entre la valeur de réalisation des actifs déterminée conformément aux dispositions des articles R. 343-11 et R. 343-12 et la somme des provisions mentionnées aux 1°, 4°, 7°, 10° et 11° de l’article R. 343-3.

Pour l’application du deuxième alinéa de l’article R. 134-2 et de l’article R. 134-5, la valeur de la part de provision de diversification à retenir est égale à la valeur de la part déterminée au prochain arrêté de compte de participation aux résultats ou, si un montant intermédiaire est calculé avant cet arrêté, au prochain montant intermédiaire divisé par le nombre de parts de provision de diversification en date de calcul de ce montant intermédiaire.
