Article A761-14 of the French Commercial code

The second part of the application to the Prefect referred to in the first paragraph of Article R. 761-12-1 includes all the information needed to examine the application, namely:

1° An indicative plan of the sales areas, where applicable before and after the requested extension;

2° Maps and plans showing:

– the location of the project on a 1:25,000 map;

– the organisation of the project on the plot or plots of land concerned: the locations and areas of the buildings, the spaces for parking vehicles, storing products, manoeuvring delivery vehicles; the areas required for the installation and operation of specific equipment, including refrigeration equipment, required for the project as well as the areas required for administrative and social premises;

– the main roads and road facilities and, where applicable, the rail or waterways serving the project;

– the surroundings of the project, over a distance of approximately 500 m from its siting site;

– the place of the project in its neighbourhood by means of a recent aerial or satellite view;

3° A graphic document showing the insertion of the construction project in relation to neighbouring buildings and landscapes as well as elements relating to the treatment of accesses and the land, making it possible to assess the impact on landscapes and ecosystems.

4° Forecast information relating to the types of delivery vehicles and vehicles of potential buyers and the anticipated increase in traffic per time slot;

5° Description of waste and wastewater treatment arrangements;

6° Forecast information relating to direct energy consumption associated with the project, which may be attested to by a quality label for premises to be built or renovated and by the signing of an energy performance contract for existing premises ;

7° The forecast elements relating to indirect energy consumption linked to supplier and customer journeys, mentioning the objectives of reducing greenhouse gases and lowering fuel consumption;

8° The presentation of any specific technical constraints of the project;

9° In the event that the project consists of accommodating the products mentioned in Article L. 761-5, an indication of the activity previously carried out on these premises.

The maps and plans mentioned above are provided in A4 or A3 format, unless documents in a larger format need to be produced.

The authorisation application file shall be sent in duplicate.

La seconde partie de la demande au préfet mentionnée au premier alinéa de l’article R. 761-12-1 comporte la totalité des éléments utiles à l’instruction de la demande, soit :

1° Un plan indicatif des surfaces de vente, le cas échéant avant et après l’extension sollicitée ;

2° Des cartes et des plans présentant :

– la localisation du projet sur une carte au 1/25 000 ;

– l’organisation du projet sur la ou les parcelles de terrain concernées : les emplacements et superficies des bâtiments, les espaces destinés au stationnement des véhicules, au stockage des produits, à la manœuvre des véhicules de livraison ; les surfaces nécessaires à l’installation et au fonctionnement des équipements spécifiques, y compris frigorifiques, nécessaires au projet ainsi que les surfaces nécessaires aux locaux administratifs et sociaux ;

– les principales voies et les aménagements routiers et, le cas échéant, les voies ferroviaires ou fluviales desservant le projet ;

– l’environnement du projet, sur une distance d’environ 500 m à partir de son site d’implantation ;

– l’inscription du projet dans son quartier au moyen d’une vue récente réalisée par voie aérienne ou par satellite ;

3° Un document graphique présentant l’insertion du projet de construction par rapport aux constructions avoisinantes et aux paysages ainsi que des éléments relatifs au traitement des accès et du terrain, permettant d’apprécier l’impact sur les paysages et sur les écosystèmes ;

4° Les éléments prévisionnels relatifs aux types de véhicules de livraison et de véhicules des acheteurs potentiels et à l’augmentation de trafic prévue par plage horaire ;

5° La description des modalités de traitement des déchets et des eaux usées ;

6° Les éléments prévisionnels relatifs aux consommations énergétiques directes liées au projet, qui peuvent être attestées par un label de qualité pour les locaux à construire ou à rénover et par la signature d’un contrat de performance énergétique pour les locaux existants ;

7° Les éléments prévisionnels relatifs aux consommations énergétiques indirectes liées aux trajets des fournisseurs et des clients, en mentionnant les objectifs de réduction des gaz à effet de serre et d’abaissement des consommations de carburants ;

8° La présentation des contraintes techniques spécifiques éventuelles du projet ;

9° Dans le cas où le projet consiste à accueillir dans un local existant les produits mentionnés à l’article L. 761-5, l’indication de l’activité exercée précédemment dans ce local.

Les cartes et plans mentionnés ci-dessus sont fournis au format A4 ou A3, sauf nécessité de production de documents sous un format supérieur.

Le dossier de demande d’autorisation est transmis en deux exemplaires.
