Article D1123-27 of the French Public Health Code

The National Commission for Research Involving the Human Person shall carry out the duties set out in Article L. 1123-1-1 and, in this capacity, shall :

1° Ensures the coordination and harmonisation of the operation of the committees for the protection of individuals, in particular by means of the recommendations it draws up;

2° Holds meetings of the Committees for the Protection of Individuals at least once a year;

3° Transmits to the Committees for the Protection of Individuals the Minister’s requests for an opinion on any organisational project likely to have an impact on their operation;

4° Gives its opinion on any question relating to the interpretation of texts falling within the exclusive remit of the Committees for the Protection of Individuals;

5° Draw up a summary of the annual activity reports of the Committees for the Protection of Individuals;

6° Distributes unfavourable opinions to all the Data Protection Committees for their information and analyses them with a view to drawing up recommendations;

7° Drawing up evaluation guidelines for the Committees for the Protection of Individuals and organising their evaluation;

8° Draw up a training programme for members of the Committees for the Protection of Individuals.

La commission nationale des recherches impliquant la personne humaine exerce les missions prévues à l’article L. 1123-1-1 et, à ce titre, elle :

1° Assure la coordination et l’harmonisation du fonctionnement des comités de protection des personnes, notamment au moyen des recommandations qu’elle élabore ;

2° Réunit les comités de protection des personnes au moins une fois par an ;

3° Transmet aux comités de protection des personnes les demandes d’avis du ministre sur tout projet d’organisation susceptible d’impacter leur fonctionnement ;

4° Donne son avis sur toute question relative à l’interprétation des textes relevant de la compétence exclusive des comités de protection des personnes ;

5° Elabore une synthèse des rapports annuels d’activité des comités de protection des personnes ;

6° Diffuse à l’ensemble des comités de protection des personnes pour information les avis défavorables et les analyse en vue d’élaborer des recommandations ;

7° Elabore le référentiel d’évaluation des comités de protection des personnes et organise leur évaluation ;

8° Elabore un programme de formation des membres des comités de protection des personnes.
