Article D1237-5 of the French Labour Code

For the application of article L. 1237-18-5, the employer sends the administrative authority an information document on the terminations pronounced as part of the mobility leave, set by order of the Minister for Employment, every six months from the date of filing of the agreement.

This document specifies in particular:

1° The number of terminations of employment contracts as a result of mobility leave;

2° The redeployment measures implemented as part of this leave, such as training, work periods in the company and support measures;

3° The employment situation of the employees at the end of the mobility leave.

Pour l’application de l’article L. 1237-18-5, l’employeur transmet à l’autorité administrative un document d’information sur les ruptures prononcées dans le cadre du congé de mobilité fixé par arrêté du ministre chargé de l’emploi tous les six mois à compter du dépôt de l’accord.


Ce document précise notamment :


1° Le nombre de ruptures de contrat de travail intervenues à la suite d’un congé de mobilité ;


2° Les mesures de reclassement mises en place dans le cadre de ce congé telles que les actions de formation, les périodes de travail en entreprise et les mesures d’accompagnement ;


3° La situation des salariés au regard de l’emploi à l’issue du congé de mobilité.
