Article D131-1-3 of the French Insurance Code

In order to select a unit of account mentioned in article R. 131-1-1 pursuant to 1° of article R. 131-1-2, the subscriber shall follow the procedure below:

1° The policyholder or member notifies the intermediary or the insurance or capitalisation undertaking, on paper or any other durable medium, of their wish to be treated as a client with the experience, knowledge and skills necessary to understand the risks they incur when selecting units of account made up of alternative investment funds open to professionals and to make their own investment decisions, either at any time or for a specific arbitrage;

2° The insurance company or intermediary must clearly explain to the person concerned, on paper or any other durable medium, the risks involved in selecting the units of account referred to in article R. 131-1-1 ;

3° The subscriber declares on paper or on any other durable medium, in a document separate from the contract, that he is aware of the consequences of his decision to select the units of account referred to in article R. 131-1-1.

Afin de sélectionner une unité de compte mentionnée à l’article R. 131-1-1 en application du 1° de l’article R. 131-1-2, le souscripteur ou l’adhérent suit la procédure ci-après :

1° Le souscripteur ou l’adhérent notifie sur support papier ou tout autre support durable à l’intermédiaire ou l’entreprise d’assurance ou de capitalisation son souhait d’être traité comme un client possédant l’expérience, les connaissances et la compétence nécessaires pour comprendre les risques qu’il encourt en sélectionnant des unités de compte composées de fonds d’investissement alternatifs ouverts à des professionnels et prendre ses propres décisions d’investissement, soit à tout moment, soit pour un arbitrage déterminé ;

2° L’entreprise ou l’intermédiaire d’assurance précise à l’intéressé, clairement et sur support papier ou tout autre support durable, les risques liés à la sélection d’unités de compte mentionnées à l’article R. 131-1-1 ;

3° Le souscripteur ou l’adhérent déclare sur support papier ou tout autre support durable, dans un document distinct du contrat, qu’il est conscient des conséquences de sa décision de sélectionner des unités de compte mentionnées à l’article R. 131-1-1.
