Article D1415-1-2 of the French Public Health Code

The Institute has legal personality from the date of publication in the Journal officiel of the approval order provided for in article D. 1415-1-1, accompanied by extracts from the constituent agreement.

The publication mentions in particular:

1° The purpose of the group constituting the institute ;

2° The identity of its members ;

3° The registered office ;

4° The rules governing the liability of members towards each other and towards third parties.

Any amendment to the founding agreement is approved by order of the ministers responsible for the budget, research and health, which is published under the same conditions as the order approving the agreement.

L’institut jouit de la personnalité morale à compter de la publication au Journal officiel de l’arrêté d’approbation prévu à l’article D. 1415-1-1, accompagné d’extraits de la convention constitutive.

La publication fait notamment mention :

1° De l’objet du groupement constituant l’institut ;

2° De l’identité de ses membres ;

3° Du siège social ;

4° Des règles de responsabilité des membres entre eux et à l’égard des tiers.

Toute modification de la convention constitutive est approuvée par arrêté des ministres chargés du budget, de la recherche et de la santé, qui fait l’objet d’une publication dans les mêmes conditions que la publication de l’arrêté d’approbation de la convention.
