Article D147-31-1 of the French Code of Criminal Procedure

Persons covered by the provisions of article D. 147-31 may not be placed under judicial supervision:

1° If they have been sentenced to socio-judicial supervision, unless this sentence was handed down for acts committed before 13 December 2005, in accordance with the provisions of the last paragraph of article 41 of law no. 2005-1549 of 12 December 2005 relating to the treatment of recidivism in criminal offences.

2° If they have been granted conditional release, judicial supervision may nevertheless be ordered when conditional release has ended following total or partial revocation.

Les personnes relevant des dispositions de l’article D. 147-31 ne peuvent pas être placées sous surveillance judiciaire :



1° Si elles ont été condamnées à un suivi socio-judiciaire, sauf si cette condamnation a été prononcée pour des faits commis avant le 13 décembre 2005, conformément aux dispositions du dernier alinéa de l’article 41 de la loi n° 2005-1549 du 12 décembre 2005 relative au traitement de la récidive des infractions pénales.



2° Si elles bénéficient d’une libération conditionnelle, la surveillance judiciaire peut toutefois être prononcée lorsque la libération conditionnelle s’est achevée à la suite d’une révocation totale ou partielle.
