Article D211-1 of the French Insurance Code

Pursuant to article L. 211-1-1, cancellation of the insurance contract is conditional upon the insured providing his insurer, no later than fifteen days after the insurer has been notified by the insured of his intention to cancel the contract, with one of the following supporting documents:

1° In the event of the transfer for destruction of a passenger car, van or three-wheeled moped to a ELV centre mentioned in 7° of article R. 543-154 of the Environment Code , a copy of the certificate of destruction of the vehicle issued to the insured under II of article R. 322-9 of the Highway Code;

2° In the event of the transfer for destruction of a vehicle other than those mentioned in 1° to a facility for the treatment of end-of-life vehicles operated in accordance with Title I of Book V of the Environmental Code, a copy of the certificate of destruction of the vehicle issued to the insured in application of II and IV of Article R. 322-9 of the Highway Code;

3° In the event of the repair of the vehicle, a copy of the second report of the automobile expert mentioned in the third paragraph of Article L. 327-3 of the Highway Code, certifying that the vehicle has undergone the safety-related repairs provided for in the first expert report and that it is roadworthy under normal safety conditions;

4° If a new policy is taken out with another insurer, a copy of one of the supporting documents issued to the insured under Articles R. 211-15 and R. 211-17.

On receipt of one of the documents mentioned in 1° to 4°, the insurer shall notify the insured in writing that the insurance contract has been cancelled. The notification shall mention the effective date of cancellation.

Article D211-1

En application de l’article L. 211-1-1, la résiliation du contrat d’assurance est conditionnée à la fourniture par l’assuré à son assureur, au plus tard dans un délai de quinze jours après que l’assureur a reçu notification par l’assuré de son intention de résilier le contrat, d’une des pièces justificatives suivantes :

1° En cas de cession pour destruction d’une voiture particulière, d’une camionnette ou d’un cyclomoteur à trois roues à un centre VHU mentionné au 7° de l’article R. 543-154 du code de l’environnement , une copie du certificat de destruction du véhicule délivré à l’assuré en application du II de l’article R. 322-9 du code de la route ;

2° En cas de cession pour destruction d’un véhicule autre que ceux mentionnés au 1° à une installation de traitement de véhicules hors d’usage exploitée conformément au titre Ier du livre V du code de l’environnement, une copie du certificat de destruction du véhicule délivré à l’assuré en application des II et IV de l’article R. 322-9 du code de la route ;

3° En cas de réparation du véhicule, une copie du second rapport de l’expert en automobile mentionné au troisième alinéa de l’article L. 327-3 du code de la route, certifiant que le véhicule a fait l’objet des réparations touchant à la sécurité prévues par le premier rapport d’expertise et qu’il est en état de circuler dans des conditions normales de sécurité ;

4° En cas de souscription d’un nouveau contrat auprès d’un autre assureur, une copie d’un des documents justificatifs délivrés à l’assuré en application des articles R. 211-15 et R. 211-17.

A réception d’un des documents mentionnés aux 1° à 4°, l’assureur notifie par écrit à l’assuré le fait que le contrat d’assurance a été résilié. La notification mentionne la date d’effet de la résiliation.
