Article D221-2-1 of the French Sports Code

I.-The agreement provided for in article L. 221-2-1 determines the reciprocal rights and obligations of the federation and the elite athlete.

1° With regard to the athlete’s training and socio-professional support, it stipulates:

-the procedures for monitoring training ;

the procedures for socio-professional integration and support;

-where applicable, the conditions and procedures for the individual allocation of personalised aid granted by the State;

-where applicable, the terms and conditions for awarding federal grants and bonuses;

2° With regard to the protection and medical monitoring of athletes, it sets out:

-the administrative management procedures for insurance against accidents at work and occupational illnesses from which the athlete benefits;

-the rights and management procedures relating to retirement from which they benefit;

the guarantees offered by the federation’s insurance to cover bodily injury to which the athlete may be exposed as a result of practising high-level sport; – the athlete’s medical check-ups

the terms and conditions of his medical follow-up;

3° For competitive sport, it mentions:

-the procedures for selection to the national team

-the obligations of the athlete in the national team, in particular those relating to behaviour and rules of dress;

4° With regard to sporting ethics and image rights, it specifies:

-the rules relating to the rights, obligations and conditions of use of the athlete’s image, as well as the athlete’s obligations towards the federation’s partners; – the rights relating to the use of the athlete’s image, as well as the athlete’s obligations towards the federation’s partners;

-the rights relating to the use of the athlete’s individual image during national selection competitions;

-the terms and conditions of the athlete’s expression and duty of confidentiality in terms of communication and advertising with regard to both the image of the federation and sport and its values;

-the rules governing sports betting and the fight against doping.

II – The agreement is signed by the President of the Federation, the National Technical Director of the Federation, the athlete and, where applicable, his or her legal representatives.

I.-La convention prévue à l’article L. 221-2-1 détermine les droits et obligations réciproques de la fédération et du sportif de haut niveau.

1° En matière de formation et d’accompagnement socioprofessionnel du sportif, elle stipule :

-les modalités du suivi de la formation ;

-les modalités de l’insertion et du suivi socioprofessionnels ;

-le cas échéant, les conditions et modalités d’attribution individuelle des aides personnalisées accordées par l’Etat ;

-le cas échéant, les conditions et modalités d’attribution des aides et primes fédérales ;

2° En matière de protection et de suivi médical du sportif, elle énonce :

-les modalités de gestion administrative en matière d’assurance accidents du travail et maladies professionnelles dont il bénéficie ;

-les droits et modalités de gestion en matière de retraite dont il bénéficie ;

-les garanties offertes par l’assurance de la fédération en matière de couverture des dommages corporels auxquels la pratique sportive de haut niveau peut l’exposer ;

-les modalités de son suivi médical ;

3° En matière de pratique compétitive, elle mentionne :

-les modalités de sélection en équipe nationale ;

-les obligations du sportif en équipe nationale, notamment celles liées au comportement et aux règles vestimentaires ;

4° En matière d’éthique sportive et de droit à l’image, elle précise :

-les règles relatives aux droits et obligations et aux conditions d’utilisation par le sportif de son image, ainsi que ses obligations vis-à-vis des partenaires de la fédération ;

-les droits liés à l’exploitation de l’image individuelle du sportif lors des sélections nationales ;

-les modalités d’expression du sportif et de son devoir de réserve en matière de communication et de publicité au regard tant de l’image de la fédération que du sport et de ses valeurs ;

-les règles en matière de paris sportifs et de lutte contre le dopage.

II.-La convention est signée par le président de la fédération, le directeur technique national de la fédération, le sportif et, le cas échéant, ses représentants légaux.
