Article D2232-7 of the French Labour Code

In the event of disagreement on the methods of organising the consultation adopted by the employer, the president of the judicial court, if the matter is referred to him by the representative trade union organisations in the undertaking or establishment, shall rule in accordance with the accelerated procedure on the merits and as a last resort.

If the matter is not referred to the president of the court within eight days of notification of the arrangements for organising the consultation, the arrangements made by the employer shall apply.

En cas de désaccord sur les modalités d’organisation de la consultation retenues par l’employeur, le président du tribunal judiciaire, s’il est saisi par les organisations syndicales représentatives dans l’entreprise ou l’établissement, statue selon la procédure accélérée au fond et en dernier ressort.

Si le président du tribunal judiciaire n’est pas saisi dans un délai de huit jours à compter de la notification des modalités d’organisation de la consultation, celles arrêtées par l’employeur s’appliquent.
