Article D292 of the French Code of Criminal Procedure

The provisions of Chapter V of Title I of Book II of the Penitentiary Code determine the conditions and procedures for the implementation of transfers and extractions of detained persons, particularly with regard to:

-taking into account the legal situation of the persons concerned;

-the cases in which the competent services are requested by the public prosecutor;

the prerogatives of the judicial authorities with regard to persons remanded in custody or convicted persons who must be held at the disposal of the court within whose jurisdiction they are located;

– the steps to be taken by the judicial authorities with regard to persons remanded in custody or convicted persons who must be held at the disposal of the court within whose jurisdiction they are located
-the steps to be taken by the judicial authority to ensure the reintegration of a detained person whose extraction it has ordered.

Les dispositions du chapitre V du titre Ier du livre II du code pénitentiaire déterminent les conditions et modalités de mise en œuvre des transfèrements et extractions des personnes détenues, notamment pour ce qui concerne :


-la prise en compte de la situation judiciaire des intéressés ;


-les cas où les services compétents sont requis par le procureur de la République ;


-les prérogatives des autorités judiciaires à l’égard des personnes placées en détention provisoire ou des personnes condamnées devant être tenues à la disposition de la juridiction dans le ressort de laquelle elles se trouvent ;


-les diligences à accomplir par l’autorité judiciaire pour assurer la réintégration d’une personne détenue dont elle a ordonné l’extraction.
