Article D3142-5 of the French Labour Code

In the absence of an agreement or arrangement as referred to in article L. 3142-14, the employee shall inform the employer by any means that provides a date certain, at least fifteen days before the start of the family solidarity leave, of his wish to suspend his employment contract for this reason, of the date of his departure on leave and, where applicable, of his request for the leave to be split up or converted into part-time leave.
He shall also send a medical certificate, drawn up by the doctor treating the person the employee wishes to assist, stating that this person is suffering from a life-threatening condition or is in the advanced or terminal stages of a serious and incurable disease.

A défaut de convention ou d’accord mentionné à l’article L. 3142-14, le salarié informe l’employeur par tout moyen conférant date certaine, au moins quinze jours avant le début du congé de solidarité familiale de sa volonté de suspendre son contrat de travail à ce titre, de la date de son départ en congé et, le cas échéant, de sa demande de fractionnement ou de transformation en temps partiel de celui-ci.
Il adresse également un certificat médical, établi par le médecin traitant de la personne que le salarié souhaite assister, attestant que cette personne souffre d’une pathologie mettant en jeu le pronostic vital ou est en phase avancée ou terminale d’une affection grave et incurable.
