Article D3253-5 of the French Labour Code

The maximum amount of the guarantee provided for in Article L. 3253-17 is set at six times the monthly ceiling used to calculate contributions to the unemployment insurance scheme.
This amount is set at five times this ceiling if the employment contract from which the claim arises was entered into less than two years and at least six months before the date of the judgment opening the collective proceedings, and at four times this ceiling if the contract from which the claim arises was entered into less than six months before the date of the judgment opening the collective proceedings.
It is assessed on the date on which the employee’s claim is due, and at the latest on the date of the judgment adopting the plan or ordering the compulsory liquidation.

Le montant maximum de la garantie prévue à l’article L. 3253-17 est fixé à six fois le plafond mensuel retenu pour le calcul des contributions au régime d’assurance chômage.
Ce montant est fixé à cinq fois ce plafond lorsque le contrat de travail dont résulte la créance a été conclu moins de deux ans et six mois au moins avant la date du jugement d’ouverture de la procédure collective, et à quatre fois ce plafond si le contrat dont résulte la créance a été conclu moins de six mois avant la date du jugement d’ouverture.
Il s’apprécie à la date à laquelle est due la créance du salarié et au plus tard à la date du jugement arrêtant le plan ou prononçant la liquidation judiciaire.
