Article D3335-16 of the French Public Health Code

The exemptions referred to in article L. 3335-4 are the subject of annual orders issued by the mayor of the municipality in which the public house whose temporary opening is requested is located.

Applications for dispensation are only admissible if they are submitted by the sports federations or groups entitled to them at least three months before the date of the planned event. These requests must specify the date and nature of the events for which an exemption is sought.

However, in the case of an exceptional event, the mayor may grant an exemption in the light of a request sent at least fifteen days before the planned date of the event.

Les dérogations mentionnées à l’article L. 3335-4 font l’objet d’arrêtés annuels du maire de la commune dans laquelle sera situé le débit de boissons dont l’ouverture temporaire est sollicitée.

Les demandes de dérogation ne sont recevables que si les fédérations sportives ou les groupements pouvant y prétendre les adressent au plus tard trois mois avant la date de la manifestation prévue. Ces demandes précisent la date et la nature des événements pour lesquels une dérogation est sollicitée.

Toutefois, en cas de manifestation exceptionnelle, le maire peut accorder une dérogation au vu de la demande adressée au moins quinze jours avant la date prévue de cette manifestation.
