Article D3335-18 of the French Public Health Code

Any establishment mentioned in article D. 3335-16 which opens a public house without the mayor’s authorisation or without complying with the conditions set by the temporary dispensation is subject to the procedures set out in articles 4 and 5 of decree no. 93-1101 of 3 September 1993 concerning the declaration of establishments in which physical and sporting activities are practised and the safety of these activities.

The operation of these temporary drinks outlets, authorised under a derogation, is subject to the obligations set out in articles L. 332-3 to L. 332-5 of the French Sports Code.

Tout établissement mentionné à l’article D. 3335-16 qui ouvre un débit de boissons sans l’autorisation du maire ou sans respecter les conditions fixées par la dérogation temporaire est soumis aux procédures énoncées aux articles 4 et 5 du décret n° 93-1101 du 3 septembre 1993 concernant la déclaration des établissements dans lesquels sont pratiquées des activités physiques et sportives et la sécurité de ces activités.

L’exploitation de ces débits de boissons temporaires, autorisés à titre dérogatoire, s’opère dans le cadre des obligations prévues par les articles L. 332-3 à L. 332-5 du code du sport.
