Article D47-1-20 of the French Code of Criminal Procedure

For the purposes of Article 694-48, where the issuing State requests, under a European Investigation Order, the hearing of a person by videoconference, the practical arrangements for the hearing, which must be carried out in accordance with the provisions of the law of the issuing State, shall be agreed in advance with the authorities of that State, specifying in particular the time and place of the hearing, the identification details of the person heard and, in the case of a suspected or accused person, the conditions under which the exercise of the rights of the defence is guaranteed.

A report shall be drawn up indicating the date and place of the hearing, the identity of the person heard, the identities and capacities of all the other persons who took part in the hearing, the taking of oaths and the technical conditions under which the hearing took place. These minutes are sent to the issuing authority.

Pour l’application de l’article 694-48, lorsque l’Etat d’émission sollicite, au titre d’une décision d’enquête européenne, l’audition d’une personne par visioconférence, les modalités pratiques de l’audition, qui doit être réalisée conformément aux dispositions du droit de l’Etat d’émission, sont préalablement fixées d’un commun accord avec les autorités de cet Etat, en précisant notamment l’heure et le lieu de l’audition, les données d’identification de la personne entendue ainsi que, s’il s’agit d’une personne suspectée ou poursuivie, les conditions dans lesquelles est garanti l’exercice des droits de la défense.

Il est dressé un procès-verbal indiquant la date et le lieu de l’audition, l’identité de la personne entendue, les identités et qualités de toutes les autres personnes ayant participé à l’audition, les prestations de serment et les conditions techniques dans lesquelles l’audition s’est déroulée. Ce procès-verbal est transmis à l’autorité d’émission.
