Article D5132-43-13 of the French Labour Code

An integration workshop or site may enter into open-ended contracts as referred to in article D. 5132-43-5, up to a limit of 20% of the number of full-time integration workstations set out in the agreement.

By way of derogation from the previous paragraph, the integration workshop or site may conclude open-ended contracts in excess of the threshold set out in the same paragraph, by decision of the Prefect of the département, up to a limit of 30% of the number of full-time integration workstations set out in the agreement. This derogation is granted by the Prefect of the département when the situation of the workshop and integration site justifies it, in particular on the basis of the number of integration jobs set by the agreement and the forecast number of terminations of open-ended inclusion contracts at the initiative of an employee.

Un atelier ou un chantier d’insertion peut conclure des contrats à durée indéterminée mentionnés à l’article D. 5132-43-5, dans la limite de 20 % du nombre de postes de travail d’insertion occupés à temps plein fixés par la convention.

Par dérogation à l’alinéa précédent, l’atelier ou le chantier d’insertion peut conclure des contrats à durée indéterminée au-delà du seuil fixé à ce même alinéa sur décision du préfet de département, dans la limite de 30 % du nombre de postes de travail d’insertion occupés à temps plein fixés par la convention. Cette dérogation est accordée par le préfet de département lorsque la situation de l’atelier et chantier d’insertion le justifie, notamment en fonction du nombre de postes d’insertion fixé par la convention et du nombre prévisionnel de ruptures de contrats de travail à durée indéterminée d’inclusion à l’initiative d’un salarié.
