Article D6124-226 of the French Public Health Code

I.-The holder of the cross-sectional imaging authorisation has a radiology team comprising:

1° One or more doctors specialising in radiology and medical imaging, who provide radiological care on site;

2° One or more medical electroradiology manipulators, present on site during the patient’s radiological care.

The authorisation holder also enlists the help of a medical physicist as part of the process of optimising exposure to ionising radiation.

II – The holder of the cross-sectional imaging authorisation may not carry out his radiology activity mainly by teleradiology, with the exception of the radiological care mentioned in 1° of article R. 6123-162.

By way of derogation from the previous paragraph, if the situation justifies it, the general director of the competent regional health agency may temporarily authorise the holder to carry out the diagnostic procedures mentioned in article R. 6123-160 remotely by teleradiology.

The provision of remote radiological care by teleradiology is part of a regional organisation and complies with all the quality requirements and stages of a patient’s radiological medical care.

I.-Le titulaire de l’autorisation d’imagerie en coupes dispose d’une équipe radiologique qui comprend :

1° Un ou plusieurs médecins spécialisés en radiologie et imagerie médicale, qui assurent les soins radiologiques sur site ;

2° Un ou plusieurs manipulateurs d’électroradiologie médicale, présents sur site au cours de la prise en charge des soins radiologiques du patient.

Le titulaire de l’autorisation s’assure également le concours d’un physicien médical dans le cadre de la démarche d’optimisation de l’exposition aux rayonnements ionisants.

II.-Le titulaire de l’autorisation d’imagerie en coupes ne peut exercer son activité de radiologie majoritairement par téléradiologie, à l’exception des soins radiologiques mentionnés au 1° de l’article R. 6123-162.

Par dérogation à l’alinéa précédent, si la situation le justifie, le directeur général de l’agence régionale de santé compétente peut autoriser temporairement le titulaire à effectuer les actes diagnostiques mentionnés à l’article R. 6123-160 à distance par téléradiologie.

La prise en charge des soins radiologiques à distance, par téléradiologie, s’inscrit dans une organisation territoriale et respecte l’ensemble des exigences de qualité et des étapes de prise en charge médicale radiologique d’un patient.
