I.-In application of the provisions of article L. 6213-10-1, medical biologists, whatever their original training, may be replaced by an intern in medicine or pharmacy, or by an intern or a doctor or pharmacist assistant in the hospitals of the armed forces, enrolled in the specialised medical biology studies diploma who has completed the first five semesters of training.
II.-1° The authorisation required for an intern in medicine to replace a medical biologist is issued under the conditions laid down in articles D. 4131-1 to D. 4131-3-1 ;
When the medical biologist being replaced is a serving member of the military, this authorisation is issued by the Conseil Départemental de l’Ordre des Médecins in the place where the intern is practising. This council will notify the Minister for Defence as soon as possible of the decision to authorise or refuse authorisation to practise and will inform the Director General of the Regional Health Agency as soon as possible of the authorisation given, specifying the identity of the intern as well as the date of issue of the authorisation and its duration;
2° The authorisation required for a medical intern to replace a pharmacist medical biologist is issued, in accordance with the provisions of the second, third and fourth paragraphs of article D. 4131-2 and article D. 4131-3, under the following conditions:
a) It is issued by the Conseil Départemental de l’Ordre des Médecins in the resident’s place of practice;
b) This departmental council immediately notifies the decision to authorise or refuse authorisation to practise to the pharmacist medical biologist being replaced or, when the replacement takes place in a health establishment, to the director of this establishment and, in the case of the replacement of an active military medical biologist, to the Minister of Defence;
c) This departmental council immediately informs the director general of the regional health agency and, except in the case of serving military pharmacists, the president of the central council of section G of the Ordre des pharmaciens of the authorisation given, specifying the identity of the intern and that of the pharmacist medical biologist concerned as well as the date of issue of the authorisation and its duration.
III -When a pharmacy intern replaces a medical biologist, he/she will provide him/her with a certificate, issued by the president of the central council of section G of the Ordre des pharmaciens, attesting that he/she meets the conditions laid down for this replacement. The issue of this certificate is subject, as far as the evidence of studies carried out is concerned, to a certificate issued to the intern by the director of the training and research unit with which he is registered with a view to obtaining the specialised diploma in medical biology. This certificate is valid for one year throughout France. It may be renewed under the same conditions, on proof of continuation of the same studies.
The president of the central council of section G of the Ordre des pharmaciens immediately informs the director general of the regional health agency and, in the event of the replacement of an active military medical biologist, the Minister of Defence, of the authorisation given, specifying the identity of the intern and that of the biologist concerned, as well as the date of issue of the certificate. This information is simultaneously sent to the departmental council of the order of doctors to which the medical biologist being replaced belongs when the latter is a doctor, unless this doctor is a serving member of the armed forces.
When the replacement takes place in a healthcare establishment, the central council of section G of the pharmacists’ association also notifies the director of the establishment concerned of its decision to authorise or refuse authorisation.
