Article D6332-18 of the French Labour Code

I.-The management, information and mission costs mentioned in article R. 6332-17 may not exceed a ceiling determined in the agreement on objectives and resources mentioned in article L. 6332-2.

These costs are defined according to the requests submitted by the skills operator and the objectives set with the minister responsible for vocational training.

The ceiling on management costs mentioned in I of article R. 6332-17 is between a minimum and a maximum determined as a percentage of the sums collected in respect of the funds mentioned in 1° and c of 3° of article L. 6123-5 and article L. 6332-1-2 by order of the minister responsible for vocational training.

II.-To prepare the agreement on objectives and resources, the skills operator will send the Minister responsible for vocational training a document including:

1° The main guidelines for its activity;

2° The corresponding changes in its costs;

3° The resources put in place to provide local services to companies and their employees throughout the territory, and to organise observatories or finance a specific joint structure fulfilling this mission;

4° A map specifying its geographical locations in the territory.

III – The agreement on objectives and resources referred to in article L. 6332-2 is for a three-year period.

The parties shall evaluate it annually.

Article D6332-18

I.-Les frais de gestion, d’information et de missions mentionnés à l’article R. 6332-17 ne peuvent excéder un plafond déterminé dans la convention d’objectifs et de moyens mentionnée à l’article L. 6332-2.

Ces frais sont définis en fonction des demandes présentées par l’opérateur de compétences et des objectifs fixés avec le ministre chargé de la formation professionnelle.

Le plafond des frais de gestion mentionné au I de l’article R. 6332-17 est compris entre un minimum et un maximum déterminés en pourcentage des sommes perçues au titre des fonds mentionnés aux 1° et c du 3° de l’article L. 6123-5 et de l’article L. 6332-1-2 par arrêté du ministre chargé de la formation professionnelle.

II.-Pour préparer la convention d’objectifs et de moyens, l’opérateur de compétences transmet au ministre chargé de la formation professionnelle un document comprenant :

1° Les principales orientations pour son activité ;

2° L’évolution correspondante de ses charges ;

3° Les moyens mis en place pour assurer les services de proximité aux entreprises et à leurs salariés sur l’ensemble du territoire, et pour organiser des observatoires ou financer une structure paritaire spécifique accomplissant cette mission ;

4° Une carte précisant ses lieux d’implantation géographique sur le territoire.

III.-La convention d’objectifs et de moyens mentionnée à l’article L. 6332-2 est triennale.

Les parties procèdent annuellement à son évaluation.
