Article L112-6-2 of the French Monetary and Financial Code

Payments made by court-appointed administrators and judicial representatives to the institutions mentioned inarticle L. 3253-14 of the Labour Code in application of articles L. 3253-15, L. 3253-16 and L. 3253-18-1 of the same code are made by bank transfer.

The payment of wages and salaries is made by transfer by the judicial representative when, prior to the opening of the collective proceedings, it was made by transfer to a bank or post office account, subject to article L. 112-10 of this code.

The first two paragraphs of this article also apply to court-appointed administrators and court-appointed agents appointed pursuant to the second paragraph of article L. 811-2 of the French Commercial Code and the first paragraph of II of article L. 812-2 of the same code.

Article L112-6-2

Les paiements effectués par les administrateurs judiciaires et les mandataires judiciaires au profit des institutions mentionnées à l’article L. 3253-14 du code du travail en application des articles L. 3253-15, L. 3253-16 et L. 3253-18-1 du même code sont assurés par virement.

Le paiement des traitements et salaires est effectué par virement par le mandataire judiciaire lorsqu’il était, avant l’ouverture de la procédure collective, effectué par virement sur un compte bancaire ou postal, sous réserve de l’article L. 112-10 du présent code.

Les deux premiers alinéas du présent article s’appliquent également aux administrateurs judiciaires et aux mandataires judiciaires désignés en application du deuxième alinéa de l’article L. 811-2 du code de commerce et du premier alinéa du II de l’article L. 812-2 du même code.
