Article L121-22 of the French Consumer Code

Any advertising of:

<1° A commercial transaction subject to authorisation or declaration under either article L. 122-24 of this Code, or articles L. 310-1 to L. 310-4 and L. 310-7 of the Commercial Code, or articles L. 752-1 and L. 752-16 of the same code, and which has not been the subject of such authorisation or declaration;

2° On a commercial operation the performance of which requires the employment of salaried staff requiring authorisation under Chapter II of Title III of Book I of Part Three of the Labour Code and carried out without first obtaining such authorisation, or which is in breach of the provisions of Chapter IV of Title III of Book I of Part Three of the same code and their implementing texts;

3° On a commercial operation carried out or to be carried out in breach of the provisions of article L. 3132-29 of the Labour Code;

4° On a commercial event subject to the declaration provided for in article L. 762-2 of the Commercial Code and which has not been the subject of this declaration.

Article L121-22

Est interdite toute publicité portant :

1° Sur une opération commerciale soumise à autorisation ou à déclaration au titre soit de l’article L. 122-24 du présent code, soit des articles L. 310-1 à L. 310-4 et L. 310-7 du code de commerce, soit des articles L. 752-1 et L. 752-16 du même code, et qui n’a pas fait l’objet de cette autorisation ou de cette déclaration ;

2° Sur une opération commerciale dont la réalisation nécessite l’emploi de personnel salarié requérant une autorisation au titre du chapitre II du titre III du livre Ier de la troisième partie du code du travail et réalisée sans l’obtention préalable de cette autorisation, ou qui est en infraction avec les dispositions du chapitre IV du titre III du livre Ier de la troisième partie du même code et de leurs textes d’application ;

3° Sur une opération commerciale réalisée ou devant être réalisée en infraction avec les dispositions de l’article L. 3132-29 du code du travail ;

4° Sur une manifestation commerciale soumise à la déclaration prévue à l’article L. 762-2 du code de commerce et qui n’a pas fait l’objet de cette déclaration.
