A sales clerk who, as a result of an accident for which he is not at fault, is unable to perform his employment contract is entitled to his salary for a maximum period of six weeks.
During this period, compensation paid by an insurance company or a mutual insurance company is not deducted from the amount of remuneration due by the employer. Any stipulation to the contrary is null and void.
A commercial clerk is an employee who, employed by a trader within the meaning of Article L. 121-1 of the French Commercial Code, performs commercial duties in the service of customers.
