Article L1233-56 of the French Labour Code

When the administrative authority detects a procedural irregularity in the course of the checks it carries out, it sends the employer a notice specifying the nature of the irregularity found. At the same time, it sends a copy of its observations to the social and economic committee.

The administrative authority may make observations on the social measures provided for in article L. 1233-32.

The employer responds to the observations of the administrative authority and sends a copy of its response to the employee representatives. If this response is made after the deadline for sending the letters of dismissal provided for in article L. 1233-39, the deadline is postponed until the date on which the response is sent to the administrative authority. Letters of dismissal may only be sent to employees from this date.

Lorsque l’autorité administrative relève une irrégularité de procédure au cours des vérifications qu’elle effectue, elle adresse à l’employeur un avis précisant la nature de l’irrégularité constatée. Elle envoie simultanément copie de ses observations au comité social et économique.

L’autorité administrative peut formuler des observations sur les mesures sociales prévues à l’article L. 1233-32.

L’employeur répond aux observations de l’autorité administrative et adresse copie de sa réponse aux représentants du personnel. Si cette réponse intervient après le délai d’envoi des lettres de licenciement prévu à l’article L. 1233-39, celui-ci est reporté jusqu’à la date d’envoi de la réponse à l’autorité administrative. Les lettres de licenciement ne peuvent être adressées aux salariés qu’à compter de cette date.
