Article L125-1-1 of the French Insurance Code

I.-The National Advisory Commission on Natural Disasters is responsible for issuing an annual opinion on the relevance of the criteria used to determine recognition of the state of natural disaster, within the meaning of article L. 125-1, and on the effective conditions for compensating disaster victims. This opinion is given in particular on the basis of an annual report produced by the interministerial commission for the recognition of the state of natural disaster mentioned in II of this article and which includes a summary of the opinions issued by the latter as well as a statement of the benchmarks used to assess the abnormal intensity of the natural agent, within the meaning of the third paragraph of article L. 125-1. The opinion also reviews the terms and conditions under which experts involved in the assessment of damage caused by natural disasters are certified and, if necessary, proposes changes. The members of the National Advisory Commission on Natural Disasters include six local representatives and representatives of disaster victims’ associations. It may hear any person it deems useful for its work. The minutes of its debates are made public under conditions laid down by decree. The tasks, composition, organisation and operation of the National Consultative Commission for Natural Disasters are specified by decree.

II.-The Interministerial Commission for the Recognition of Natural Disaster Status is a technical commission responsible for issuing an opinion on applications for recognition of natural disaster status submitted to it by the ministers concerned, on the basis of expert reports. The organisation, operation and procedures for communicating the opinions of the Interministerial Commission are specified by decree.

III – The annual opinion issued by the Commission referred to in I and the annual report drawn up by the Commission referred to in II are forwarded each year to Parliament and to the Conseil d’orientation pour la prévention des risques naturels majeurs referred to in article L. 565-3 of the Environment Code.

Article L125-1-1

I.-La Commission nationale consultative des catastrophes naturelles est chargée de rendre annuellement un avis sur la pertinence des critères retenus pour déterminer la reconnaissance de l’état de catastrophe naturelle, au sens de l’article L. 125-1, et sur les conditions effectives de l’indemnisation des sinistrés. Cet avis est rendu notamment sur le fondement d’un rapport annuel produit par la commission interministérielle de reconnaissance de l’état de catastrophe naturelle mentionnée au II du présent article et qui comprend un bilan synthétique des avis rendus par celle-ci ainsi qu’un état des référentiels retenus pour apprécier l’intensité anormale de l’agent naturel, au sens du troisième alinéa de l’article L. 125-1. L’avis dresse également un bilan des modalités et conditions selon lesquelles les experts qui interviennent pour l’évaluation de dommages occasionnés par des catastrophes naturelles sont certifiés et propose, le cas échéant, des évolutions. La Commission nationale consultative des catastrophes naturelles comprend, parmi ses membres, six membres titulaires de mandats locaux et des représentants des associations de sinistrés. Elle peut entendre toute personne dont l’audition lui paraît utile à ses travaux. Les comptes rendus de ses débats sont rendus publics, dans des conditions prévues par décret. Les missions, la composition, l’organisation et le fonctionnement de la Commission nationale consultative des catastrophes naturelles sont précisés par décret.

II.-La commission interministérielle de reconnaissance de l’état de catastrophe naturelle est une commission technique chargée d’émettre un avis sur les demandes de reconnaissance de l’état de catastrophe naturelle dont elle est saisie par les ministres concernés, sur la base de rapports d’expertise. L’organisation, le fonctionnement et les modalités de communication des avis de la commission interministérielle sont précisés par décret.

III.-L’avis rendu annuellement par la Commission mentionnée au I et le rapport annuel établi par la commission mentionnée au II sont transmis chaque année au Parlement et au Conseil d’orientation pour la prévention des risques naturels majeurs mentionné à l’article L. 565-3 du code de l’environnement.
