Article L1251-28 of the French Labour Code

Early termination of the assignment contract at the employee’s initiative entitles the temporary employment agency to damages corresponding to the loss suffered.

These provisions do not apply when the employee can prove that a permanent employment contract has been concluded.

Unless the parties agree otherwise, the employee is then required to observe a period of notice calculated on the basis of one day per week, taking into account :

1° The total duration of the contract including, where applicable, its one or two renewals, if it includes a specific term ;

2° The duration completed when the contract does not include a specific term.

In both cases, the total period of notice may not be less than one day or more than two weeks.

La rupture anticipée du contrat de mission qui intervient à l’initiative du salarié ouvre droit pour l’entreprise de travail temporaire à des dommages et intérêts correspondant au préjudice subi.

Ces dispositions ne s’appliquent pas lorsque le salarié justifie de la conclusion d’un contrat de travail à durée indéterminée.

Sauf accord des parties, le salarié est alors tenu de respecter un préavis dont la durée est calculée à raison d’un jour par semaine, compte tenu :

1° De la durée totale du contrat incluant, le cas échéant, son ou ses deux renouvellements, lorsque celui-ci comporte un terme précis ;

2° De la durée accomplie lorsque le contrat ne comporte pas un terme précis.

Dans les deux cas, la durée totale du préavis ne peut être inférieure à un jour ni supérieure à deux semaines.
