Article L1262-3 of the French Labour Code

An employer may not rely on the provisions applicable to the secondment of employees when, in the State in which it is established, it carries out activities relating solely to internal or administrative management, or when its activity is carried out on national territory on a regular, stable and continuous basis. In particular, he may not rely on these provisions when his activity involves seeking out and canvassing customers or recruiting employees in this territory.

In these situations, the employer is subject to the provisions of the Labour Code applicable to companies established on national territory.

Un employeur ne peut se prévaloir des dispositions applicables au détachement de salariés lorsqu’il exerce, dans l’Etat dans lequel il est établi, des activités relevant uniquement de la gestion interne ou administrative, ou lorsque son activité est réalisée sur le territoire national de façon habituelle, stable et continue. Il ne peut notamment se prévaloir de ces dispositions lorsque son activité comporte la recherche et la prospection d’une clientèle ou le recrutement de salariés sur ce territoire.

Dans ces situations, l’employeur est assujetti aux dispositions du code du travail applicables aux entreprises établies sur le territoire national.
