The transfer of a competence automatically entails the transfer to the beneficiary local authority of the movable and immovable assets used, on the date of this transfer, for the exercise of this competence.
To draw up these minutes, the parties may call on the advice of experts, half of whose fees will be paid by the local authority benefiting from the transfer and half by the local authority previously responsible. Failing agreement, the parties may seek arbitration from the President of the competent Regional Audit Chamber. This arbitration must be completed within two months.
The terms of this provision are specified by articles L. 1321-2 and L. 1321-5 depending on whether the local authority that previously exercised jurisdiction was the owner or the lessee of the assets handed over.
