I. – Provided that their payment account is accessible online, payment service users may access their payment account data via a payment service provider of their choice providing the account information service referred to in 8° of II of Article L. 314-1.
II. – When providing the account information service, the payment service provider :
1° obtains the express consent of the payment service user ;
2° Ensure that the payment service user’s personalised security data is not accessible to parties other than the payment service user and the issuer of the data and ensure that the data is transmitted securely;
3° Identifies itself, for each communication session, to the payment service provider(s) managing the payment service user’s accounts and communicates securely under the conditions set out in the delegated act adopted pursuant to Article 98.1 of Directive (EU) 2015/2366 of the European Parliament and of the Council of 25 November 2015 on payment services in the internal market with the payment service provider(s) managing the accounts and the payment service user ;
4° Accesses only information from payment accounts designated by the payment service user and associated payment transactions ;
5° Does not request sensitive payment data linked to payment accounts;
6° uses, consults or stores data only for the purposes of providing the account information service expressly requested by the Payment Service User.
III. – When a payment service user uses an account information service, his payment service provider managing the account :
1° Communicates securely under the conditions set out in the delegated act adopted pursuant to Article 98.1 of the aforementioned Directive (EU) 2015/2366 of the European Parliament and of the Council of 25 November 2015 with the payment service providers providing the account information service ;
2° Processes data requests transmitted by payment service providers providing the account information service without any discrimination, other than based on objective reasons.
IV. – The provision of the account information service is not conditional on the existence of a contractual relationship between the payment service providers providing the account information service and the payment service providers managing the accounts.
