Article L1337-1-1 of the French Public Health Code

Without prejudice to the powers granted to officers or agents of the judicial police, to labour inspection officers and to mining police officers, the offences provided for in this chapter, those provided for in the regulations adopted in application of chapter III of this title, the offences against the rules of prevention mentioned inarticle L. 4451-1 of the Labour Code, as well as the offences concerning radiation protection provided for in 2° and 9° of I of article L. 512-1 of the Mining Code and in article 141 of the Mining Code as amended by decree no. 56-838 of 16 August 1956 on the Mining Code and the texts which have supplemented or amended it, are investigated and recorded by the agents mentioned in articles L. 1333-29 and L. 1333-30, authorised and sworn under the conditions set by decree in the Conseil d’Etat.

They exercise this authority under the same conditions as those laid down in articles L. 172-2 and L. 172-3 and in Section 2 of Chapter II of Title VII of Book I of the Environment Code.

They have the same rights and prerogatives and have the same duties as those conferred by the said section on the civil servants and agents mentioned in article L. 172-4 of this code.

In addition, when they are doctors, the documents, software and data mentioned in article L. 172-11 of the Environment Code are extended to those containing individual medical data.

Article L1337-1-1

Sans préjudice des pouvoirs reconnus aux officiers ou agents de police judiciaire, aux agents chargés de l’inspection du travail et à ceux chargés de la police des mines, les infractions prévues au présent chapitre, celles prévues par les règlements pris en application du chapitre III du présent titre, les infractions aux règles de prévention mentionnées à l’article L. 4451-1 du code du travail ainsi que les infractions concernant la radioprotection prévues aux 2° et 9° du I de l’article L. 512-1 du code minier ainsi qu’à l’article 141 du code minier dans sa rédaction issue du décret n° 56-838 du 16 août 1956 portant code minier et des textes qui l’ont complété ou modifié sont recherchées et constatées par les agents mentionnés aux articles L. 1333-29 et L. 1333-30, habilités et assermentés dans les conditions fixées par décret en Conseil d’Etat.

Ils exercent cette compétence dans les mêmes conditions que celles prévues aux articles L. 172-2 et L. 172-3 et à la section 2 du chapitre II du titre VII du livre Ier du code de l’environnement.

Ils disposent des mêmes droits et prérogatives et ont les mêmes devoirs que ceux conférés par ladite section aux fonctionnaires et agents mentionnés à l’article L. 172-4 de ce code.

En outre, lorsqu’ils ont la qualité de médecin, les documents, logiciels et données mentionnés à l’article L. 172-11 du code de l’environnement sont étendus à ceux comprenant des données médicales individuelles.
