Article L1421-2 of the French Labour Code

Industrial tribunal members shall perform their duties with complete independence, impartiality, dignity and probity and shall behave in such a way as to exclude any legitimate doubt in this respect. In particular, they shall refrain from any public act or behaviour incompatible with their duties.

They are bound to secrecy in their deliberations.

They shall be prohibited from taking any concerted action likely to halt or obstruct the operation of the courts when the postponement of the examination of a case might have irremediable or manifestly excessive consequences for the rights of a party.

Les conseillers prud’hommes exercent leurs fonctions en toute indépendance, impartialité, dignité et probité et se comportent de façon à exclure tout doute légitime à cet égard. Ils s’abstiennent, notamment, de tout acte ou comportement public incompatible avec leurs fonctions.


Ils sont tenus au secret des délibérations.


Leur est interdite toute action concertée de nature à arrêter ou à entraver le fonctionnement des juridictions lorsque le renvoi de l’examen d’un dossier risquerait d’entraîner des conséquences irrémédiables ou manifestement excessives pour les droits d’une partie.
