Article L1423-11 of the French Labour Code

In the event of a lasting interruption in its operation or serious difficulties making it impossible to operate under normal conditions, the industrial tribunal may be dissolved by a decree stating the reasons.

In this case, new appointments must be made within a maximum period of four months from the date of publication of the dissolution decree. The duties of the members thus appointed end at the same time as those of the members of the other industrial tribunals.

Until the new industrial tribunal is installed, disputes are referred to the industrial tribunal closest to the claimant’s place of residence within the same jurisdiction of the court of appeal or, failing this, to the judicial court.

En cas d’interruption durable de son fonctionnement ou de difficultés graves rendant ce fonctionnement impossible dans des conditions normales, le conseil de prud’hommes peut être dissous par décret motivé.

Dans ce cas, les nouvelles nominations ont lieu dans un délai maximum de quatre mois à partir de la parution du décret de dissolution. Les fonctions des membres ainsi nommés prennent fin en même temps que celles des membres des autres conseils de prud’hommes.

Jusqu’à l’installation du nouveau conseil, les litiges sont portés devant le conseil de prud’hommes le plus proche du domicile du demandeur dans le même ressort de cour d’appel ou, à défaut, devant le tribunal judiciaire.
