Article L1441-10 of the French Labour Code

A councillor who has been dismissed pursuant to article L. 1442-14 may not stand as a candidate.

An appointed councillor who refuses to be installed, who is declared to have resigned or who is deemed to have resigned pursuant to article L. 1442-1, may not be a candidate for a period of four years from the date of his refusal, from the date of the court decision declaring him to have resigned or from the date of expiry of the period provided for in the third paragraph of article L. 1442-1.

Ne peut être candidat le conseiller prud’homme déclaré déchu en application de l’article L. 1442-14.

Le conseiller prud’homme nommé, qui refuse de se faire installer, qui est déclaré démissionnaire ou qui est réputé démissionnaire en application de l’article L. 1442-1, ne peut être candidat pendant un délai de quatre ans à compter de son refus, de la décision du tribunal qui le déclare démissionnaire ou de l’expiration du délai prévu au troisième alinéa de l’article L. 1442-1.
