The health democracy territories provided for inarticle L. 1434-9 are defined by the health agency for Guadeloupe, Saint-Barthélemy and Saint-Martin at the level of these local authorities and may cover the territorial jurisdiction of the agency, or be smaller or larger than it. They are defined after consultation with the representatives of the State in Guadeloupe, Saint-Barthélemy and Saint-Martin, the Health and Autonomy Conference and, for activities falling within their remit, after consultation with the President of the Departmental Council of Guadeloupe and the Presidents of the Territorial Councils of Saint-Barthélemy and Saint-Martin.
In I ofarticle L. 1434-10, the first paragraph and the first and third sentences of the second paragraph are not applicable in Guadeloupe. A decree in the Conseil d’Etat determines the composition of the specialised mental health commission, its operating procedures and the appointment of its members.
