Article L1454-1-3 of the French Labour Code

If, unless there is a legitimate reason, a party does not appear, either in person or represented in accordance with the procedures laid down by decree in the Conseil d’Etat, the conciliation and referral office may rule on the case on the basis of the documents and arguments that the appearing party has communicated to the other party.

In this case, the Conciliation and Referral Office rules as a judgement office in its restricted composition mentioned in article L. 1423-13.

Si, sauf motif légitime, une partie ne comparaît pas, personnellement ou représentée selon des modalités prévues par décret en Conseil d’Etat, le bureau de conciliation et d’orientation peut juger l’affaire, en l’état des pièces et moyens que la partie comparante a contradictoirement communiqués.

Dans ce cas, le bureau de conciliation et d’orientation statue en tant que bureau de jugement dans sa composition restreinte mentionnée à l’article L. 1423-13.
