Article L1542-1 of the French Public Health Code

Title I of Book II of this Part is applicable in New Caledonia and French Polynesia, in the wording resulting from Law no. 2016-41 of 26 January 2016 on the modernisation of our healthcare system, subject to the following adaptations:

1° Articles L. 1211-2, L. 1211-3 with the exception of its second paragraph, and L. 1211-6-1 are applicable in their wording resulting from Law no. 2021-1017 of 2 August 2021.

2° Article L. 1211-4 is replaced by the following provisions:

Art. L. 1211-4 – No payment, in whatever form, may be made to a person who lends himself to the removal of parts of his body or to the collection of its products.

Only the costs incurred may be reimbursed, where applicable.

3° Article L. 1211-7 does not apply;

4° Article L. 1211-9 is replaced by the following provisions:

“Art. L. 1211-9 -The list of human body products mentioned in article L. 1211-8 is determined by decree in the Conseil d’Etat. “

For the application of Article L. 1211-2 to New Caledonia, the second sentence of the second paragraph is deleted.

Article L1542-1

Le titre Ier du livre II de la présente partie est applicable en Nouvelle-Calédonie et en Polynésie française, dans sa rédaction résultant de la loi n° 2016-41 du 26 janvier 2016 de modernisation de notre système de santé, sous réserve des adaptations suivantes :

1° Les articles L. 1211-2, L. 1211-3 à l’exception de son deuxième alinéa, et L. 1211-6-1 sont applicables dans leur rédaction résultant de la loi n° 2021-1017 du 2 août 2021.

2° L’article L. 1211-4 est remplacé par les dispositions suivantes :

Art. L. 1211-4.-Aucun paiement, quelle qu’en soit la forme, ne peut être alloué à celui qui se prête au prélèvement d’éléments de son corps ou à la collecte de ses produits.

Seul peut intervenir, le cas échéant, le remboursement des frais engagés.

3° L’article L. 1211-7 n’est pas applicable ;

4° L’article L. 1211-9 est remplacé par les dispositions suivantes :

” Art. L. 1211-9.-La liste des produits du corps humain mentionnés à l’article L. 1211-8 est déterminée par décret en Conseil d’Etat. “

Pour l’application à la Nouvelle-Calédonie de l’article L. 1211-2, la deuxième phrase du deuxième alinéa est supprimée.
