Title I of Book II of this Part is applicable in New Caledonia and French Polynesia, in the wording resulting from Law no. 2016-41 of 26 January 2016 on the modernisation of our healthcare system, subject to the following adaptations:
1° Articles L. 1211-2, L. 1211-3 with the exception of its second paragraph, and L. 1211-6-1 are applicable in their wording resulting from Law no. 2021-1017 of 2 August 2021.
2° Article L. 1211-4 is replaced by the following provisions:
Art. L. 1211-4 – No payment, in whatever form, may be made to a person who lends himself to the removal of parts of his body or to the collection of its products.
Only the costs incurred may be reimbursed, where applicable.
3° Article L. 1211-7 does not apply;
4° Article L. 1211-9 is replaced by the following provisions:
“Art. L. 1211-9 -The list of human body products mentioned in article L. 1211-8 is determined by decree in the Conseil d’Etat. “
For the application of Article L. 1211-2 to New Caledonia, the second sentence of the second paragraph is deleted.
