Article L173-23 of the French Insurance Code

Subject to the provisions of article L. 173-24, the injured third party has a direct right of action against the insurer covering the civil liability of the person liable.

The insurer may not pay to a party other than the injured party all or part of the sum owed by him, as long as that party has not been paid and to that extent, except in the case of allocation of the insurance indemnity to the constitution of the limitation fund, under the terms of article 62 of law no. 67-5 of 3 January 1967 on the status of ships and other seagoing vessels.

Article L173-23

Le tiers lésé dispose, sous réserve des dispositions de l’article L. 173-24, d’un droit d’action directe à l’encontre de l’assureur garantissant la responsabilité civile de la personne responsable.

L’assureur ne peut payer à un autre que le tiers lésé tout ou partie de la somme due par lui, tant que ce tiers n’a pas été désintéressé et dans cette mesure, sauf en cas d’affectation de l’indemnité d’assurance à la constitution du fonds de limitation, dans les termes de l’article 62 de la loi n° 67-5 du 3 janvier 1967 portant statut des navires et autres bâtiments de mer.
