Article L2000-1 of the French Public procurement code

Where a purchaser concludes a contract intended to satisfy objectively separable needs which are subject, on the one hand, to the ordinary law on contracts set out in Book I of this Part and its Book II relating to partnership contracts and, on the other hand, to the special legal regime applicable to other public contracts set out in Book V or to other concession contracts set out in Book II of Part Three, this contract is subject to the ordinary law on contracts set out in Book I and Book II relating to partnership contracts of this Part.

Lorsqu’un acheteur conclut un contrat destiné à satisfaire des besoins, objectivement dissociables, qui relèvent, d’une part, du droit commun des marchés prévu au livre Ier de la présente partie et de son livre II relatif aux marchés de partenariat et, d’autre part, du régime juridique particulier applicable aux autres marchés publics prévu au livre V ou aux autres contrats de concession prévu au livre II de la troisième partie, ce contrat est soumis au droit commun des marchés prévu au livre Ier et au livre II relatif aux marchés de partenariat de la présente partie.
