Natural or legal persons registered in the register referred to in I of article L. 211-18 of this code may enter into any timeshare contract governed by articles L. 224-69 et seq. of the French Consumer Code.
They may also assist in the conclusion of such contracts by virtue of a written mandate.
In order to carry out the latter activity, they must provide special proof, in accordance with the conditions set out in this Title, of insurance covering the financial consequences of their professional civil liability and a financial guarantee for the repayment of funds, bills or securities held on behalf of third parties.
The amount of this guarantee may not be less than the maximum amount of funds, bills or securities held on behalf of third parties at any one time, nor less than a minimum amount set by decree in the Conseil d’Etat.
The specific procedures for implementing and operating this guarantee, the content of the mandate contract and the terms and conditions of the agent’s remuneration are defined by decree in the Conseil d’Etat.
