Article L2135-9 of the French Labour Code

A joint fund, entrusted with a public service mission, providing a contribution to the financing of employees’ trade union organisations and employers’ professional organisations, in respect of their participation in the design, implementation, evaluation or monitoring of activities contributing to the development and exercise of the missions defined in article L. 2135-11, shall be created by an agreement concluded between the representative organisations of employees and employers at national and cross-industry level. This agreement shall determine the organisation and operation of the fund in accordance with this section.

The agreement establishing the joint fund is subject to approval by the Minister responsible for labour. In the absence of an agreement or approval by the latter, the procedures for creating the fund and its organisational and operational conditions are defined by regulation.

The joint fund is authorised to receive the resources mentioned in article L. 2135-10 and to allocate them to employees’ trade union organisations and employers’ professional organisations under the conditions set out in articles L. 2135-11 to L. 2135-17.

Article L2135-9

Un fonds paritaire, chargé d’une mission de service public, apportant une contribution au financement des organisations syndicales de salariés et des organisations professionnelles d’employeurs, au titre de leur participation à la conception, à la mise en œuvre, à l’évaluation ou au suivi d’activités concourant au développement et à l’exercice des missions définies à l’article L. 2135-11, est créé par un accord conclu entre les organisations représentatives des salariés et des employeurs au niveau national et interprofessionnel. Cet accord détermine l’organisation et le fonctionnement du fonds conformément à la présente section.

L’accord portant création du fonds paritaire est soumis à l’agrément du ministre chargé du travail. A défaut d’accord ou d’agrément de celui-ci, les modalités de création du fonds et ses conditions d’organisation et de fonctionnement sont définies par voie réglementaire.

Le fonds paritaire est habilité à recevoir les ressources mentionnées à l’article L. 2135-10 et à les attribuer aux organisations syndicales de salariés et aux organisations professionnelles d’employeurs dans les conditions prévues aux articles L. 2135-11 à L. 2135-17.
